The Owner: Is the owner (or their legal representative) of the Property being booked.

The Guest: Is the person booking a holiday in accordance with these Conditions.

The Deposit: is the deposit referred to during the booking process.

The ‘Security Deposit’: is the amount described as such on the booking form that is dealt with as set out in these Terms and Conditions and that you must pay when booking (taken on behalf of the Owner). We set out how the Security Deposit works in these Terms and Conditions.

1. General – The Holiday

The Guest, by booking the property enters into a contract with the Owner subject to these Conditions. Nothing herein contained shall be deemed to create a legal demise or any greater interest than a licence for the purpose of only a holiday on the terms herein provided. The contract is not effective until the required payment has been received and confirmation sent to the Guest.

2. Liability

The Owner does not accept liability for any act, neglect or default on the part of any other person not within their employ or otherwise under their control; nor for any accident, damage, loss, injury, expense or inconvenience, whether to person or property, which the Guest or any other person may suffer or incur arising out if, or in any way connected with the occupation. In addition, the Owner accepts no liability for loss of or damage to the Guests personal property.

The Owner accepts no responsibility for personal injury to, or death, of any Guests, or for other matters over which the Owner has no control, except to the extent such personal injury or death is caused by negligence or wilful default by the Owner. Every effort is made to ensure all items of equipment described and supplied by the Owners are in good working order; however, no guarantee is given, or liability accepted if breakdowns occur before or during a holiday and whilst the Owner will endeavour to organise repairs or replacements as quickly as possible, delays may occur, particularly during the main season.

3. Eligibility

Bookings cannot be accepted from persons under the age of 25 years. Group bookings of single sex parties are not allowed unless special arrangements are made with the Owner (additional security deposits may be required).

4. Authority to Sign

The ‘Guest’ who completes the booking, whether over the telephone, in writing or online, is deemed the legal signatory. The Guest certifies that they are authorised to sign the Booking Form on behalf of all persons who will occupy the property during the period for which they have booked and that they, including those substituted or added at a later date, are aware of the Booking Conditions. A booking is confirmed by payment of deposit and constitutes acceptance of the Booking Conditions and the advertised price. The Owner reserves the right to decline any booking or to refuse to hand over a key to any person who is not considered suitable, or who has not complied with the booking conditions.

5. Occupancy

Rentals are for a maximum of 4 weeks and commence at 4 pm on the start day of the holiday. The property must be vacated by 10 am on the day of departure to allow sufficient time to prepare the property for the next guest. Failure to comply may incur premium cleaning charges that must be paid for by the Guest.

The number of persons occupying a property must not exceed the maximum stated in the current property description (babies who do not occupy a bed are not counted as a member of the party). Occupation of the property by more than the maximum number of guests is not permitted and will result in the booking being terminated, resulting in a forfeit of payments and immediate vacation of the property.

Guests must inform the Owner if occupants of the holiday group changed significantly before or during the occupation of the property.

Under no circumstances should parties be held at the property without prior consent of the owner.

6. Security Deposit Scheme

You must pay the Security Deposit at the time of making your final payment. The Security Deposit (the cost of which is stated on the Booking Form) will be held on behalf of the Owner to be applied against the reasonable costs of miscellaneous repairs and/or replacement and additional cleaning of the Holiday Property, including to furnishings, kitchen equipment, crockery, glass, beds, bedding and towels damaged or soiled otherwise than by usual wear and tear during the Holiday Period by you or other members of your Party. The balance of the Security Deposit (if any) will be returned to you within 14 days of the Departure Date where the Owner agrees that you have no liability to such costs. Where such costs exceed the Security Deposit, you must pay the excess within 14 days of being notified of the amount.

7. Bookings

A booking is made once the deposit (or full rental if within 60 days of the start of the holiday) and the booking fee has been paid, and any optional extras are paid, and the owner has then confirmed the booking. Any booking fees are payable per booking and are non-refundable.

If any optional extras are being provided, as required by the Guest, the Guest will be charged at the rates shown/advised. A holiday booking is a legally binding contract and the deposit paid upon booking is accepted in part payment for the property letting.

8. Holiday Insurance

The Guest is strongly recommended to secure holiday insurance through any broker of the Guest’s choice.

9. Damage to the Property

The Guest shall be liable for the full cost of any damage, which the Guest or a member of their party, or its additional guests or invitees during their stay cause to the Property in connection with a booking (being before, during or after the Holiday period). The Guest must report immediately any accidents, losses or damage that may have occurred during the occupation however minor or serious so that things may be put right for the Guest and/or for the next guests, as soon as possible.

10. Final Payments

The balance of the booking is payable 60 days before the start of the holiday. The balance due date can be found on your confirmation form. If the balance is not received within five days of the due date, the owner reserves the right to cancel the booking as per the conditions for cancellations and re-let the property.

11. Non-availability of Property

In the event of the accommodation becoming unavailable for any reason, the Owner will refund all monies paid, or a proportion in the case of curtailment, whereupon the Owners liability will cease.

12. Changing a Booking

Once the booking has been confirmed, the booking cannot be transferred to another property by the owner and will be treated as a cancellation of the original reservation (see cancelling a booking) unless a new date can be accommodated. The dates of a booking on a property may on occasion be changed (normally limited to within the same calendar year) but this is subject to availability and the Owners’ agreement. Any changes may be subject to an administration charge.

13. Cancelling a Booking

A Guest who wishes to cancel the booking must notify the owner in writing; a phone call alone will not suffice. If the Guest cancels the booking more than 60 days before the date of arrival, the deposit will be forfeited to the Owner will be entitled to keep it.

If the Guest cancels the booking within 60 days of the date of arrival (or fails to take up the accommodation without cancelling the booking) the whole of the rental shall be forfeited to the Owner.

For bookings through a 3rd party booking service, cancellations are managed per the terms shown at the time of booking.

There are no exceptions to the cancellation terms. The Guest must ensure that adequate travel insurance is in place before making a booking.
